1. About Booksia

• Booksia is an online platform/marketplace where users list, buy, sell, and exchange books directly with each other.


• Booksia does not own, stock, inspect, or take possession of books listed by users.


• Booksia is not a party to transactions between users and does not act as agent for any user.


• All aspects of transactions—including pricing, payment, shipping, delivery, returns, and exchanges—are arranged solely between users.

2. Eligibility

You must be at least 18 years old, or have verifiable parental/guardian consent, to use the Service. You agree to provide accurate, current, and complete information when creating an account or listing items.

3. User Responsibilities

• Provide accurate titles, descriptions, conditions, and images of listed books.


• Communicate honestly and respectfully with other users.


• Negotiate, arrange, and complete transactions directly with other users.


• Comply with all applicable laws and regulations (including consumer law and copyright).


• Ensure you have the right to sell or exchange any book you list.

4. Prohibited Content & Conduct

You must not use the Service to:

• List or trade prohibited items, counterfeit goods, stolen property, or items infringing intellectual property rights.


• Engage in fraud, deception, harassment, hate speech, or abusive behaviour.


• Post false, misleading, or inappropriate content.


• Circumvent technical measures, interfere with the Service, or scrape without permission.

We may remove listings, restrict features, or suspend/terminate accounts at our discretion for violations.

5. Shipping & Delivery

• Shipping method, cost, timing, and insurance are decided between buyer and seller.


• Risk of loss passes according to the agreement between users and the chosen carrier’s terms.


• Users should keep proof of postage, tracking, and delivery as applicable.

6. Payments & Fees

• Users are responsible for choosing and using a safe payment method. Booksia is not a payment provider and does not hold funds for users.


• If Booksia offers optional paid features (e.g., promoted listings), fees will be disclosed prior to purchase and are non-refundable unless required by law.


• Users are responsible for any taxes arising from their transactions.

7. Exchanges, Returns & Refunds

We recommend users document item condition, packaging, and shipping and agree in writing (e.g., in‑app messages) on return/exchange terms before a transaction.

8. Risk Disclaimer

Using the Service involves inherent risks, including transacting with strangers, potential disputes, item misdescription, non‑delivery, and payment issues. You use the Service at your own risk. Booksia makes no guarantees about listing accuracy, item quality, safety, legality, availability, or delivery.

9. Limitation of Liability

To the fullest extent permitted by law:

• Booksia (and our directors, employees, and affiliates) will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, goodwill, data, or opportunity; or costs of substitute goods/services, arising from or related to your use of the Service or any user‑to‑user transaction.


• Booksia disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non‑infringement.


• Booksia is not liable for errors, interruptions, delays, security incidents, or loss/corruption of data.

Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law or other applicable law.

10. User Disputes

Booksia is not a mediator or arbitrator. Users must resolve disputes directly with each other. We may (but are not obliged to) assist with communication or provide limited information consistent with our Privacy Policy and applicable law.

11. Account Suspension & Termination

We may suspend or terminate access to the Service (and remove listings) for violations of these Terms, suspected fraud, unlawful activity, or to protect users or the platform. You may close your account at any time, but certain provisions will survive termination.

12. Intellectual Property

Except for user‑generated content, all content on the Service (including the Booksia name, logos, text, graphics, and software) is owned by or licensed to Booksia and protected by intellectual property laws. You must not copy, modify, distribute, or create derivative works without permission.

13. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described there.

14. Changes to Terms

We may update these Terms from time to time. Changes take effect when posted on the website with an updated “Last Updated” date. Your continued use of the Service constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of Western Australia. You submit to the exclusive jurisdiction of the courts of Western Australia in relation to any dispute arising from or connected with these Terms or the Service.
